DHS voter probe may break state laws and wrongly implicate US citizens, whistleblower alleges

The Trump administration’s effort to identify noncitizens who may be registered to vote is facing legal challenges and scrutiny after a federal whistleblower alleged that Department of Homeland Security employees were directed to use state voter databases in ways that may violate state law.

According to the whistleblower, U.S. Citizenship and Immigration Services employees were reassigned in late August to a DHS program called the “Unlawful Voter Initiative.” After less than two hours of training, employees were reportedly instructed to search state voter-registration systems for individuals identified by DHS as possible noncitizens. Workers were expected to review about 40 people per day, leaving roughly 12 minutes for each case.

A central concern is how employees accessed voter information. In Virginia, the state’s online voter lookup system is intended for individuals checking their own registration records. The whistleblower alleges federal employees were instructed to enter information as though they were those voters. Virginia Attorney General Jay Jones has asked DHS to confirm whether employees accessed records without voters’ permission and ordered the department to preserve access logs, correspondence and training materials. Jones says such activity could violate Virginia election and privacy laws.

The whistleblower also argues that DHS data may be incomplete or outdated, potentially resulting in U.S. citizens—particularly naturalized citizens—being incorrectly identified in federal law-enforcement records as possible unlawful voters. Democratic Sens. Chuck Schumer and Alex Padilla, who released the disclosure, have called for the initiative to be stopped and investigated.

DHS disputes those criticisms. The department says it is cross-referencing publicly available state voter information with federal records of known noncitizens and describes the effort as a legitimate election-security measure. DHS says its employees are conducting the investigations professionally and that its goal is to prosecute noncitizens who illegally vote and protect lawful votes.

The controversy is part of a broader administration effort to examine voter rolls before the November 2026 midterm elections. The Justice Department has sought detailed voter information from numerous states, while the administration has argued that noncitizen voting could pose an election-integrity problem. AP notes that available research has found actual voting by noncitizens to be rare.

Separately, the Coalition for Humane Immigrant Rights, represented by the UCLA Voting Rights Project, has sued the administration. The group argues that federal database comparisons could wrongly flag eligible naturalized citizens and lead to legitimate voters being removed from registration rolls. The lawsuit seeks to block the federal review of California voter records and challenges the administration’s authority to conduct the program.

In short: the dispute is not simply over whether noncitizens should be prevented from voting—noncitizen voting in federal elections is already illegal. The legal questions concern how the federal government is identifying suspected cases, whether federal employees are lawfully accessing state-controlled voter information, whether the underlying data are reliable, and whether eligible citizens could be mistakenly flagged or removed from voter rolls.
